Terms and Warranty

Gara Inc. D.B.A. Grow-It-LED (S-Corp) is here to provide high quality, American made Grow Lights and components for use by our customers and commercial entities. Use of Grow-It-LED Products for any unlawful purpose is strictly prohibited.

Orders

Orders shall not be deemed accepted by Grow-It-LED until a customer has received an order confirmation. Grow-It-LED reserves the right to refuse any order or cancel any order, even after the acceptance of such request, for any reason in Grow-It-LED’s sole discretion.

Return Policy

The Grow-It-LED Products are individually configured for each of our customers. Therefore, Grow-It-LED Products are subject to a 25% restocking fee for returned products, see details below. 

Products must be returned within 15 business days from delivery date. The product must be in NEW condition and USED products will be subject to a 25% restocking fee. 

If the buyer experiences remorse over the purchase, this will also result in a 25% restocking fee and the buyer will be responsible for the return label.

If the product was damage beyond repair, the buyer will not have to pay restocking fees nor return shipping. A new product will be shipped to the buyer as a replacement. A claim MUST be made with the shipping company AND pictures of destroyed product must be produced or the replacement product claim will be DENIED.

Note that individual LED components purchased separately and prototype product versions, as discussed in the Component and Prototype Purchases section, are not subject to the Limited Product Warranty below.

Payment Policies for Purchases from Grow-It-LED 

Charges will be immediately deducted from your account, whether using PayPal or by credit card. Grow-It-LED will only ship your order when we verify the funds have entered our account and have cleared any type of bank hold. You, as the customer, will be required to pay any applicable sales tax, duties, shipping, and insurance costs. 

Shipping

Complete fixture assemblies are eligible for free shipping; other products, components, etc. require that we charge shipping. Shipping and insurance costs are the customer’s responsibility. The title will pass to the customer upon shipment.

Policy Regarding Damaged Items

To ensure that your products are eligible for reimbursement through the shipping company, we highly recommend that you scrutinize the parcel for any damage. If the box looks beaten, the chances are that the product will have suffered some type of damage. In the unlikely event of such damage, do not discard any of the boxes, shipping labels, packaging material, or broken items. The shipping company is required to pick up the damaged goods and give you a claim number. Send us the claim numbers so we can follow up on the claim status, note; this may take 5 to 20 business days. If we can verify that your product is damaged due to shipping issues, we will send out another replacement part at your expense. If the delivery company accepts responsibility for the request, we will promptly issue a refund to your credit card or another payment system once Grow-It-LED receives reimbursement from the delivery company.

Policy Regarding Backorders and Delivery Delays

Backorders

Backorders will be shipped when the affected product becomes available. Sometimes, this takes an extended period due to certain factors like component shortages and shipping issues. 

Delivery Delays

Some of our products available on our store may not be in stock and are still awaiting assembly at our factory. Being as we are the manufacturer and store, we may need a few extra days, possibly weeks, to ensure that our components are delivered to us. Since our products offer a large amount of customizability, there may be significant delays due to the options you selected at checkout. In the event of any type of delay, we will make it our prerogative to inform you about your order. Once the components are received, and the delay has been rectified, we will immediately ship your order. 

International Orders

Currently, Grow-It-LED is only shipping to the United States and Canada. We are sorry for the inconvenience. 

Dispute Resolution Policy

In any event you, our customer, have any disputes or discrepancies regarding Grow-It-LED, we will use reasonable efforts and methods to resolve them. As part of this process, you agree and acknowledge that as the customer or cardholder, you will not initiate a chargeback or claim with our merchant or creditor without first contacting us (Grow-It-LED). Please provide us with the opportunity to resolve any disputes or discrepancies even if we cannot provide a solution.

Component and Prototype Purchases

Our component offerings (LED Drivers, LED boards, any of our offerings that aren’t a complete fixture) are sold “as is” and do not come with ANY warranty. Grow-It-LED does not warrant that the components or prototypes will be suitable for your specific use of such items. Using these products is at the customers’ sole risk, Grow-It-LED shall not be liable for any injury, death, or damage resulting from the use or misuse of our LED component offerings. All sales are final and are not eligible or subject to refund. If your components arrive damaged, please see our policy regarding damaged items above. We highly recommend that you work with or consult someone who is knowledgeable in the installation, maintenance, and use of the LED components that we offer. Grow-It-LED is available for any questions regarding these components and installation. 

LIMITED PRODUCT WARRANTY

Your Grow-It-LED products, excluding all components and any of our offerings that are not fully assembled LED Grow Lights, are covered by a limited five-year warranty from the original date of purchase. If any substantial defect in material or quality arises with your Grow-It-LED product and you follow our warranty claim procedure within the warranty period, you will be eligible for one of the Sole and Exclusive Remedies shown below.

Our Limited Warranty is non-transferable, that means you, as the original end purchaser, are the only individual eligible for the Warranty. Proof of purchase is required for validation and warranty service. You must make warranty claims directly to Grow-It-LED. Note that Grow-It-LED cannot be held liable, in any manner, for any damages to personal property resulting from any misuse or improper care of the Grow-It-LED product.

Exclusions and Limitations

The Limited Warranty only covers products sold by Grow-It-LED or authorized resellers. It does not cover Grow-It-LED products that were sold by non-authorized resellers, online auctions, or private party sales. Warranty claims will be DENIED if we cannot verify the original seller. 

The Limited Warranty only applies to the Grow-It-LED product. If in the event our product is bundled with other products and sold as a “kit,” our product warranty only covers Grow-It-LED products. Normal wear and tear are expected. Thus the Limited Warranty does not apply to damage to the Grow-It-LED Product caused by accident, abuse, misuse, use for any purpose other than its intended purpose, acts of God, or any alteration or modification. If the Grow-It-LED product has been tampered with, the Warranty will be void.

Sole and Exclusive Remedy     

Your sole and exclusive remedy for any breach by Grow-It-LED of this Limited Warranty, and Our sole and entire liability for such violation, is at our option, to repair or replace the defective Grow-It-LED Product. If repair or replacement is not possible, a refund of the purchase price is permissible. Grow-It-LED is not responsible for the labor associated with repair or replacement of parts. Grow-It-LED reserves the right to send the same or similar component (Grow-It-LED is not responsible for component shortages; similar components can be used to amend the situation). Shipping costs are the customers’ responsibility until we can verify the warrantied product, then the customer will be reimbursed for the replacement shipping cost. Replacement or repaired Grow-It-LED Products are warranted as above only for the remainder of the original applicable Warranty Period.

Obtaining Warranty Service

If you wish to claim this Limited Warranty for a Grow-It-LED Product, email [email protected], and provide the following information in your email:

Provide the following; Product Part Number, Purchase Date, Brief description of the problem.

Grow-It-LED requires the above information before the warranty claim can be accepted. Once Grow-It-LED validates your request, we will issue a Return Merchandise Authorization number (RMA) and shipping information and tracking from [email protected]. Under no circumstance will Grow-It-LED accept any shipment that is sent COD.

Please note that Grow-It-LED cannot accept returned Grow-It-LED Products in packages without an RMA number. Your RMA number must be marked on the outside of the package containing your returned Grow-It-LED Product.

IF YOU, THE CUSTOMER, ARE UNABLE TO OR FAIL TO WRITE THE RMA NUMBER ON THE OUTSIDE OF THE BOX, THE PARCEL WILL NOT BE ACCEPTED AND WILL BE RETURNED TO YOU AT YOUR EXPENSE.

You are required to use an insured shipping service (FedEx, UPS, etc.) to return your product. You must ensure that all insurance requirements are met (tracking number included). We are not responsible for any damage that occurs during shipment. Please provide us with return information when available.

Warranty Disclaimers

EXCEPT AS EXPRESSLY SET FORTH ABOVE IN THIS LIMITED PRODUCT WARRANTY SECTION, EACH GROW-IT-LED PRODUCT IS PROVIDED SOLELY ON AN “AS IS” BASIS AND GROW-IT-LED MAKES NO OTHER WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GROW-IT-LED 

SPECIFICALLY DISCLAIMS AND EXCLUDES ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF NON-INFRINGEMENT, QUIET ENJOYMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF SUCH DISCLAIMER OF ANY IMPLIED WARRANTY IS NOT PERMITTED BY LAW, THE DURATION OF ANY SUCH IMPLIED WARRANTY IS LIMITED TO THE DURATION OF THE WARRANTY PERIOD OF THE LIMITED WARRANTY AS SET FORTH ABOVE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY MAY LAST, SO SUCH LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. IF APPLICABLE LAW SPECIFIES A MINIMUM WARRANTY PERIOD THAT IS LONGER THAN THE WARRANTY PERIOD OUTLINED IN THE LIMITED WARRANTY, THEN THE WARRANTY PERIOD FOR GROW-IT-LED PRODUCTS SUBJECT TO SUCH APPLICABLE LAW SHALL BE CONFORMED TO THE MINIMUM PERIOD SO REQUIRED. THIS WARRANTY GIVES YOU THE SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION.

LIMITATION OF LIABILITY                                                                                      

OUR PRODUCTS MUST BE USED ONLY IN CONFORMANCE WITH THE OPERATING INSTRUCTIONS. OUR PRODUCTS OPERATE WITH HIGH VOLTAGE, AND IMPROPER USE CAN RESULT IN INJURY OR DEATH. GROW-IT-LED IS NOT RESPONSIBLE FOR ANY DAMAGE OR INJURY THAT OCCURS DUE TO IMPROPER USE OF OUR PRODUCTS.

IN NO EVENT, UNDER ANY CAUSE OF ACTION OF THEORY OF LIABILITY, SHALL GROW-IT-LED, ITS DISTRIBUTORS OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OF ANY NATURE WHATSOEVER, ARISING OUT OF THE USE OF OR INABILITY TO USE ANY PRODUCT, INCLUDING, WITHOUT LIMITATION, PROPERTY DAMAGE, PERSONAL INJURY, DEATH, LOSS OF VALUE OF THE PRODUCT OR ANY THIRD PARTY PRODUCTS THAT ARE USED IN OR WITH OUR PRODUCT, OR LOSS OF USE OF THE PRODUCT OR ANY THIRD PARTY PRODUCTS THAT ARE USED IN OR WITH OUR PRODUCT, EVEN IF GROW-IT-LED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED HEREIN AND ALL DIRECT OR GENERAL DAMAGES IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE), THE ENTIRE AGGREGATE LIABILITY OF GROW-IT-LED AND ANY OF ITS DISTRIBUTORS or SUPPLIERS SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO LIABILITY. SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THE LIMITATIONS OF LIABILITY SET FORTH ABOVE SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.
